By accessing and using Clean Cuts Trees' website (cleancutstrees.com) or services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Clean Cuts Trees provides professional tree care services including but not limited to:

• Tree removal and trimming
• Emergency tree services
• Storm damage cleanup
• Stump grinding
• Tree health assessment and treatment
• Land clearing services
• Municipal and commercial tree services

3. SMS/Text Messaging Terms

By providing your mobile phone number, you expressly consent to receive text messages from Clean Cuts Trees. You agree to the following terms:

• Consent: You consent to receive text messages for service appointments, updates, confirmations, and promotional offers
• Message Frequency: Message frequency varies but may include appointment reminders, service updates, and occasional promotional messages
• Charges: Standard message and data rates may apply. Check with your wireless carrier
• Opt-Out: Reply "STOP" to any message to opt-out. You may also contact us at (801) 473-7548
• Help: Reply "HELP" for assistance or contact (801) 473-7548
• Carrier Support: Supported carriers include major U.S. carriers. Not all carriers are supported
• Privacy: Your information is protected according to our Privacy Policy

4. Service Agreement and Estimates

Estimates

• All estimates are provided free of charge
• Estimates are valid for 30 days unless otherwise specified
• Final pricing may vary based on actual site conditions and scope of work
• Additional charges may apply for services beyond the original estimate

Service Execution

• Services will be performed by licensed and insured professionals
• We will make reasonable efforts to protect your property during service
• Access to the work area must be provided by the customer
• Weather conditions may affect scheduling and service delivery

5. Payment Terms

• Payment is due upon completion of services unless other arrangements are made
• We accept cash, check, and major credit cards
• A service charge may apply to returned checks
• Past due accounts may be subject to interest charges and collection fees

6. Liability and Insurance

Our Liability

Clean Cuts Trees maintains comprehensive general liability insurance and workers' compensation coverage. Our liability is limited to the direct cost of services provided and does not extend to:

• Pre-existing tree or property conditions
• Acts of nature or weather-related damage
• Underground utilities not properly marked
• Property damage caused by falling debris in high wind conditions
• Indirect, consequential, or punitive damages

Customer Responsibilities

• Ensure proper utility marking before service
• Remove vehicles and personal property from work areas
• Secure pets during service
• Provide accurate property information and access

7. Emergency Services

Emergency services are available 24/7 and are subject to:

• Higher rates due to urgency and after-hours service
• Safety assessments before work begins
• Possible delays due to weather or safety conditions
• Priority given to life-safety situations

8. Cancellation Policy

• Services may be cancelled up to 24 hours before scheduled appointment without penalty
• Cancellations with less than 24 hours notice may incur a service charge
• We reserve the right to reschedule services due to weather or safety concerns
• Emergency services cannot typically be cancelled once crew is dispatched

9. Property Rights and Cleanup

• Removed wood and debris may be retained by Clean Cuts Trees unless otherwise agreed
• Cleanup includes removal of major debris but not fine sawdust or minor debris
• Stump grinding includes removal of surface roots and grinding 4-6 inches below grade
• Seed and soil for stump holes are available at additional cost

10. Warranty and Guarantees

• We guarantee our workmanship for 30 days after service completion
• Tree health and survival cannot be guaranteed due to natural factors
• Warranty does not cover damage from weather, pests, or customer actions
• Warranty claims must be reported within the warranty period

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Clean Cuts Trees and is protected by copyright laws. You may not reproduce or distribute our content without written permission.

12. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

1. Direct communication with our management team
2. Mediation if direct resolution is unsuccessful
3. Binding arbitration in Utah if mediation fails
4. Utah state courts for issues not subject to arbitration

13. Governing Law

These terms are governed by the laws of the State of Utah. Any legal action must be brought in Utah courts with jurisdiction over our service areas.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services constitutes acceptance of modified terms.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
